car rental services and airport transfers, and transportation
of courier goods with Baden Transfer.
§ 1 Scope
The following terms and conditions apply to all services provided by the company Baden Transfer for passenger transport in occasional services, rental car traffic and airport transfer and the carriage of courier goods. By booking a service, you accept it. The valid version of the Terms and Conditions will be published on the Internet and in the offices of Baden Transfer and is always available in our vehicles. The current version of the GTC is valid at the time the contract is concluded. Deviating or conflicting terms and conditions are only valid if they have been accepted by Baden Transfer in writing.
§ 2 Conclusion
2.1. Offers by Baden Transfer are non-binding, as far as we do not bind ourselves to a specific deadline.
2.2. The contract is concluded with the verbal, written or electronically submitted order and the subsequent written confirmation
by Baden Transfer. An email is acknowledged by the customer as a letter of confirmation. Baden Transfer does not check the accuracy of individual components of the order such as addresses, departures and arrival times. The customer is liable for the accuracy of this information.
2.3. If the content of the confirmation differs from the order of the orderer, the orderer has a new contract offer, which he can accept within 10 days. Decisive is the receipt of the confirmation at Baden Transfer.
§ 3 Performance
3.1. By concluding the contract Baden Transfer undertakes to carry out the agreed carriage. Subcontractors can be used to fulfill the service. A claim for the employment of a certain vehicle does not exist.
3.2. In the case of airport transfer, a boarding is generally agreed. Further ascents require a written confirmation and will be charged additionally.
3.3. In the agreed prices, the transport of one piece of luggage up to max. 20 kg and one carry-on per person included. Any excess baggage must be registered in advance. For the promotion, a surcharge will be charged. The transport is guaranteed only with our confirmation.
3.4. For children we have the necessary safety systems ready. Registration with details of the child’s size and weight is mandatory.
3.5. The time of pick-up will be determined by Baden Transfer up to 3 days before commencement of service, as far as this was not already done when the contract was concluded. Decisive are the arrival times indicated by the customer. If the customer wishes other departure times than specified by us, or if the departure is delayed due to the fault of the customer, we are not liable for any resulting delays in the arrival. We are also not liable for damage caused by false information at the time of conclusion of the contract, as well as for delays due to traffic congestion, extreme weather conditions, air traffic control strikes and force majeure, unless they are based on intent or gross negligence on the part of Baden Transfer.
§ 4 Prices and payments
4.1. The price agreed upon conclusion of the contract and the agreed payment method apply. When paying in cash, the full price for the outward and return journey is due on the outward journey.
4.2. Additional costs that occur due to requests for changes by the customer during the journey and have not been agreed will be charged additionally. The rebooking fee is 2.50 EUR per transaction.
4.3. For amounts less than € 100.00 an invoice fee of € 5.00 will be charged. Invoices are due 14 days after receipt without deduction.
§ 5 Resignation
5.1. The customer can withdraw from the contract at any time. Baden Transfer charges the following flat-rate cancellation fees: up to 3 days before the start of the contract: 5,00 EUR handling fee until 24 h before the order starts: 30% of the agreed price then 60% of the agreed price, if the vehicle has not yet left the depot. 100% of the agreed price, as far as the vehicle has left the depot. Decisive is the receipt of the termination at the headquarters of Baden Transfer.
5.2. Baden Transfer may withdraw from the contract before the start of the contract if extraordinary circumstances have occurred which the company is not responsible for. In this case, the purchaser is only entitled to compensation for expenses incurred with the booking.
5.3. Baden Transfer may terminate the contract even after departure, if the provision of the services by force majeure, or by unforeseeable circumstances such as war, riots, epidemics, disabilities by state authorities, road blocks or strikes and stoppages that are not responsible for him or by the customer or his accompanying persons are caused. Baden Transfer also agrees proportionally on the agreed price for the services rendered.
§ 6 Liability
6.1. Baden Transfer is liable for property damage on the basis of § 23 of the Passenger Transport Act insofar as the property damage does not exceed 1000 EUR, unless the property damage is due to intent and gross negligence on which Baden Transfer is responsible.
6.2. The contractual liability of Baden Transfer for damage that is not personal injury is limited to three times the transport price, unless there is intent or gross negligence.
6.3. The customer has to submit his claims for non-contractual fulfillment within one month after execution of the service.
§ 7 Gerichtsstad
The law of the Federal Republic of Germany applies to these business relations and the entire legal relationship between Baden Transfer and the contractual partner.
Jurisdiction is the seat of Baden Transfer.
§ 8 Severability clause
The invalidity of individual provisions of the contract as well as these general terms and conditions do not result in the ineffectiveness of the contract and the terms and conditions. The European Commission provides a platform for online dispute resolution (OS), available here http://ec.europa.eu/consumers/odr/. Consumers have the opportunity to use this platform to resolve their disputes. We also declare our willingness to do so.
